Welcome to Noctis (“we”, “us”, “our”). These Terms of Service (“Terms”) apply to your use of noctislight.com.au (the “Site”) and any purchases made through the Site.

By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2) Using our site

You agree not to:

  • use the Site for any unlawful purpose

  • interfere with the Site’s security or operation

  • copy, scrape, or misuse Site content without permission

We may update, suspend, or withdraw the Site (or parts of it) at any time.

3) Products & small-batch nature

Our products are made in small batches. Minor variations in finish, texture, and appearance may occur and are part of the handmade/small-batch process.

Product colours may also appear different depending on your screen/device settings and lighting conditions.

4) Pricing, currency & payment

  • Prices are shown in [AUD]

  • Payment must be received in full before an order is processed.

  • We may use third-party payment providers to process transactions. We do not store full payment card details.

5) Orders, confirmation & cancellations

Once you place an order, you’ll receive an order confirmation email. This does not guarantee acceptance if, for example:

  • an item is unavailable

  • there is a pricing or listing error

  • we suspect fraudulent activity

Cancellations: If you need to cancel or change an order, email noctislightperth@gmail.com as soon as possible. If the order has already shipped, we may not be able to cancel it.

6) Pricing or listing errors

We take care to keep product information accurate, but errors may occur. If we discover an error in pricing, availability, or product description, we may:

  • correct the error, or

  • cancel the order and issue a refund

7) Shipping

We offer free worldwide shipping. Dispatch times and delivery estimates vary by location and are outlined in our Shipping Policy.

By ordering, you agree that:

  • delivery estimates are not guaranteed

  • delays can occur due to carriers, peak periods, weather, or customs

  • international orders may incur duties/taxes/import fees, which are the customer’s responsibility

8) Returns & refunds

Returns and refunds are governed by our Returns & Refunds Policy, including change-of-mind returns and procedures for faulty/damaged goods.

9) Warranty

Our warranty terms are outlined in our Warranty Policy.

This is provided in addition to your rights under the Australian Consumer Law.

10) Intellectual property

All content on this Site - including product designs, images, photos, videos, text, graphics, branding, and logos - is owned by Noctis or licensed to us.

You may not reproduce, distribute, or use our content for commercial purposes without written permission.

11) Limitation of liability

To the extent permitted by law:

  • We are not liable for indirect or consequential losses (such as lost profits) arising from your use of the Site or purchase of products.

  • Our liability for any claim relating to products or the Site is limited to the amount you paid for the relevant product (except where the law requires otherwise).

Nothing in these Terms excludes rights you have under the Australian Consumer Law or other applicable consumer protection laws.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
